1. Who We Are

1Digital® Agency (“1Digital,” “we,” “us,” “our”) is a US-based eCommerce digital agency founded in 2012. We provide SEO, PPC, web design, web development, and platform migration services.

2. What Information We Collect

We collect the following categories of information:

  • Contact form data: name, email address, phone number, company name, project description, and budget range submitted through our request-a-quote or contact forms.
  • Zoom scheduler: name and email address when you book a discovery call through our Zoom scheduler.
  • Analytics data: page views, session duration, referral source, and device type collected through Google Analytics 4 (GA4).
  • Cookies: session cookies, preference cookies, and analytics cookies (see Section 5 below).
  • Text-message consent: your mobile number and your choice to receive texts, if you tick the text-message box on a form (see Section 12).
  • Newsletter subscriptions: email address and first name if you opt in to our email newsletter.

We do not knowingly collect personal information from children under the age of 13. If you believe we have inadvertently collected such information, please contact us so we can delete it promptly.

3. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiry or project request.
  • Schedule and conduct discovery calls.
  • Send you the newsletter you requested. We only send marketing emails to people who have explicitly opted in.
  • Analyze site usage and improve our website and services.
  • Fulfill our legal obligations and enforce our agreements.

We will not use your information for any purpose that is materially different from those disclosed in this policy without first obtaining your consent.

4. How We Share Your Information

We do not sell your personal information. We may share it with the following categories of third parties only to the extent necessary to operate our business:

  • Google Analytics: Anonymized analytics data is shared with Google to help us understand how visitors use our website.
  • Zoom: Your name and email address are shared with Zoom when you schedule a call through our Zoom scheduler.
  • Vercel / Cloudflare: Infrastructure providers through whose networks your data transits when you access our website.
  • Cloudflare Turnstile:On certain tools (such as our free AI Visibility Check), we use Cloudflare Turnstile to verify you're a real visitor and prevent automated abuse. Turnstile runs silently and collects limited device/browser signals for this purpose. See Cloudflare's Turnstile Privacy Addendum for details.
  • Supabase: Our backend infrastructure provider. Form submission data may be stored in a US-region Supabase instance.

Text-message opt-in data and consent are never shared with anyone (see Section 12).

We require all third-party service providers to respect the security of your data and to process your personal information only for specified, legitimate purposes in accordance with our instructions.

5. Cookies

We use the following types of cookies:

  • Essential cookies: Required for the site to function correctly. These cannot be disabled.
  • Analytics cookies: Used by Google Analytics 4 to collect anonymized usage data. You can opt out of analytics cookies via our cookie consent banner or through your browser settings.
  • Preference cookies: Store your cookie consent choices so we remember your preferences on future visits.

Our cookie consent banner appears on your first visit. You can update your cookie preferences at any time by clicking the “Cookie Settings” link in our site footer. You can also manage or delete cookies through your browser settings; however, disabling essential cookies may affect site functionality.

6. Data Retention

  • Contact form submissions: Retained for up to 2 years, or until you request deletion.
  • Analytics data:Retained according to Google Analytics' default retention period (26 months).
  • Newsletter: Retained until you unsubscribe. We will process your unsubscribe request promptly.

7. Your Rights

Depending on your location and applicable law, you may have the following rights with respect to your personal information:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request that we correct inaccurate or incomplete data.
  • Deletion: Request that we delete your personal data.
  • Opt out of analytics: Decline or withdraw consent for analytics cookies via our cookie banner at any time.
  • Unsubscribe: Opt out of our newsletter at any time via the unsubscribe link in any email we send you.

To exercise any of these rights, email us at info@1digitalagency.com. We will respond within a reasonable timeframe and in accordance with applicable law.

8. California Residents (CCPA)

If you are a California resident, the California Consumer Privacy Act (CCPA) gives you specific rights regarding your personal information:

  • Right to know: You have the right to know what personal information we collect about you, the purposes for which we use it, and the categories of third parties with whom we share it.
  • Right to delete: You have the right to request deletion of your personal information, subject to certain exceptions.
  • Right to opt out of sale: You have the right to opt out of the sale of your personal information. We do not sell personal information.
  • Right to non-discrimination: We will not discriminate against you for exercising your CCPA rights.

9. International Transfers

1Digital® Agency is based in the United States. If you are accessing our website from the European Union, European Economic Area, United Kingdom, or other regions with data protection laws that may differ from US law, please be aware that your information will be transferred to and processed in the United States. By using our site or submitting a form, you consent to this transfer.

We implement reasonable safeguards to protect your personal information during international transfers, including using reputable infrastructure providers.

10. Security

We implement reasonable technical and organizational measures designed to protect your personal information from unauthorized access, alteration, disclosure, or destruction. These measures include using HTTPS encryption, access controls, and reputable third-party infrastructure providers (Vercel, Cloudflare, Supabase).

No method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

11. Google User Data

Clients of 1Digital Agency who use our client dashboard (the 1Digital AI Dashboard, at app.1digital.ai) may choose to connect their own Google account so that their data appears inside their dashboard. Connecting a Google account is optional, is always initiated by the client, and can be disconnected at any time from the same page, which revokes our access.

When connected, we request only the following access:

  • Google Analytics (read-only):to display the client’s own website traffic, top pages and traffic sources in their dashboard. We never modify their Analytics configuration.
  • Google Search Console (read-only):to display the search queries, clicks, impressions and average position for the client’s own site. We never submit sitemaps or change any setting.
  • Google Calendar: only for clients who enable appointment booking on their website. We read availability so visitors are not double-booked, and write confirmed appointments to the calendar.
  • Google Business Profile: only for clients who enable the Reviews feature. We read reviews left on their Business Profile to display on their website, and publish the replies they write.

This data is shown only to that client and to the 1Digital Agency staff working on their account. It is never shared with other clients, sold, or used for advertising.

Limited Use disclosure.1Digital Agency’s use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements. The use of raw or derived user data received from Workspace APIs will adhere to the Google User Data Policy, including the Limited Use requirements. We do not use, transfer, or sell Google user data (raw, aggregated, or derived) to create, train, or improve any foundational or generalized machine learning or artificial intelligence model.

Clients can also review or revoke our access at any time from their Google account permissions page.

12. Text Messages (SMS)

If you tick the text-message box on one of our forms, you are asking to receive text messages from 1Digital about your request. This applies to the forms on every site operated by 1Digital® Agency Inc., including 1digitalagency.com, app.1digital.ai, 1digitalmarketing.com, geniusecommerce.com and workspacecms.ai.

  • We first send one text asking you to reply YES. We send nothing further unless you do.
  • After that, our team texts you only about your request. Message frequency varies.
  • Message and data rates may apply.
  • Reply STOP at any time to opt out, or HELP for help. You can also email info@1digitalagency.com.
  • Agreeing to receive texts is never a condition of any purchase.

No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Text-messaging opt-in data and consent are excluded from all of the sharing described in Section 4 and will not be shared with any third parties.

13. Third-Party Links

Our website may contain links to third-party websites, tools, or services (such as social media platforms, review sites, or partner resources). We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy policies of any third-party sites you visit.

14. Changes to This Policy

We may update this Privacy Policy periodically to reflect changes in our practices, technology, legal requirements, or other factors. The “Last updated” date at the top of this page indicates when the policy was last revised. We encourage you to review this page periodically. Continued use of our site after changes are posted constitutes your acceptance of the updated policy.
